Policy Brief Launch: From Resilient Communities to Responsible Authorities: A Rights-Based Approach to Climate-Based Extreme Weather Events
The main points of the "From Resilient Communities to Responsible Authorities: A Rights-Based Approach to Climate-Based Extreme Weather Events (Dirençli Toplumlardan Sorumlu İdarelere: İklim Temelli Aşırı Hava Olaylarına Hak Temelli Bir Yaklaşım)" which examines the foundations of the legal responsibility of the administration against climate-based disasters in Turkey along with the possibilities and limits of the legal instruments in the hands of the citizens in the context, were shared with the public by the author and contributors, at the meeting held on May 31.
In particular, the concept of force majeure, which the administration uses to deny its responsibility, has been discussed. The validity of this concept in the context of climate change has been questioned. This policy note is based on one-on-one interviews with lawyers alongside a secondary source review. The main objective of the policy note is to go beyond the approach that categorizes the population as vulnerable and resilient in the face of natural disasters and to contribute to the development of a rights-based approach to climate-based disasters. With such an approach, vulnerability and resilience are re-established not as inherent characteristics of groups but as consequences resulting from the unequal distribution of services offered to them.
